This Privacy Policy (“Policy”) describes the Company's policies and procedures on the collection, use and disclosure of your information pursuant to your use of the Company’s website (available at NavExM.com/en-us) and related mobile and software applications, whether existing now or in future (collectively, the “Online Platforms”).   • Transfer any funds from/to your linked Bank account
  • Correspond with us by phone, e-mail chat or otherwise
  • Place an order on the Website or on the App, as the case may be,
  • Subscribe to NavExM’ newsletter, if applicable,
  • We troubleshoot problems reported by you
  • Respond to a survey or fill out a form on the Website or on the App, for the limited purposes of identifying you personally, communicating with you, in the context of provision of NavExM’s Services, in compliance with the requirements of law.
Voluntary Disclosure To Third Parties

This Privacy Policy shall not apply to any information voluntarily disclosed by you to other Users of our Online Platforms or third parties other than Selected Third Parties.

Security

We maintain administrative, technical, and physical safeguards designed to protect the personal information we maintain against unauthorized access or disclosure. No system can be completely secure. Therefore, although we take steps to secure your information, we cannot guarantee that your information, searches, or other communication will always remain secure. When registering for our services, choose a complex password and turn on advance security features, such as two-factor authentication. Never share your account credentials with third-parties and submit a customer service ticket on [email protected] if you become aware of unauthorised access to or use of your account. You are responsible for all activity on the account that is associated with your login credentials.

Age Limitations

We do not allow use of our Services and Sites by anyone younger than 18 years old. If you learn that anyone younger than 18 has unlawfully provided us with personal data, please contact us at our official [email protected] and we will take steps to delete such information, close any such accounts, and prevent the user from continuing to use our Services.

Privacy Policy Changes

The Company may change and update this Privacy Policy from time to time. We will use commercially reasonable efforts to generally notify all users of any material changes to this Privacy Policy, however, you should look at this Privacy Policy regularly to check for such changes. We will also update the “Last Updated” and “Effective date“ at the top of this Privacy Policy, which reflects the effective date of such policy. Biometric Data

We may collect Biometric Data during the onboarding or account reactivation process. Specifically, we collect Biometric Data from you when you create an account with us and submit photographs and/or videos of your face. These identifiers include facial recognition data, as well as mathematical representations of your facial geometry. We use and share Biometric Data only as described in this section.

We use Biometric Data to identify and authenticate you, for security purposes. We may share Biometric Data with third-party service providers who assist with our IT, security, and fraud programs, our professional advisors, in a business transfer such as a merger or acquisition, and as required by law or regulation. We do not sell your Biometric Data.

Retention of Biometric Data

NavExM will retain biometric data until the earliest of the following events occurs:

  • 1. to identity verification purposes for the collection have been satisfied; or
  • 2. three years from the time at which you delete or deactivate your NavExM account.

By using Online Platforms, you agree and consent to the collection and use of information collected in the manner described above and in accordance with this Privacy Policy. You also agree and consent to any changes made to this Privacy Policy in due course and without notice. If you do not agree with the terms and conditions of this Privacy Policy, please do not provide any information to us. If you refuse or withdraw your consent, or if you choose not to provide us with any information as required by us, we may not be able to provide you with the Services that are being offered through the Online Platform.

Information Disclosure To Outside Parties

We do not sell, trade, or otherwise transfer your Personal Information to outside parties. This does not include trusted third parties and subcontractors who assist us in operating the Website and the App, conducting our business, or servicing you, so long as those parties agree to keep this information confidential and ensure the same level of data protection that is adhered to by NavExM. We may also release your information to:

  • Share your personal data with Selected Third Party; which means and includes selected partners and third parties including our service providers who authenticate KYC and other details as provided by you, commercial banks which provide banking facilities to NavExM; payment processing companies and other Digital Asset exchanges as NavExM may work with for providing the NavExM platform Services etc.

However, non-personally identifiable visitor information may be provided to other parties for gaining insights and/or other uses. We use certain information in an aggregated form across users to compile statistical and demographic profiles for our business and marketing activities.

Applicability

This Privacy Policy applies to information collected through NavExM's platform including the Website as well as the App, if any.

Governing Law

This Privacy Policy shall be governed by US laws and rules framed thereunder and any amendment, modification, statutory enactment thereto from time to time. Any dispute that may arise from this Privacy Policy shall be subject to the exclusive jurisdiction to the courts of Delaware
